Typical last day to sue on the policy
Estimates only. Business-day counts skip weekends but not holidays. Your policy may set a different suit deadline, or measure it from a different date. Talk to a lawyer before relying on any date.
WHERE THESE DATES COME FROM
- Suit deadline: many Texas policies require suit within two years and one day from the date of loss. Texas law doesn't allow a policy to shorten it to less than two years.
- Presuit notice: weather claims need written notice at least 61 days before suit under Insurance Code Chapter 542A.
- Insurer deadlines: the Prompt Payment Act, Insurance Code Chapter 542. See your rights under Texas insurance law.
- TWIA: windstorm claims through the Texas Windstorm Insurance Association must be reported within one year of the loss.
